Good lord. Don't have her arrested for a bad check. She's been thru enough. If you know that the divorce was messy it's quite possible that her ex left her with empty bank accounts and lots of bills. Work with her. Let her pay in installments. It would be different if she was a deadbeat prior to the divorce.

Have you contacted your State's Attorney's office yet? Illinois has set up a Bad Check Program. There are specific guidelines you need to follow and forms that you will need to fill out. Basically, the State's Attorney contacts the check writer and demands payment. If payment is not made, they prosecute. He/she will also have to pay a fine and attend a class on writing bad checks. Maybe the only way to get money from her would be to let her pay you in installments? I don't know for sure what to do in this situation. We don't have a lot of money and if I had to pay a $400 bill all at once I just wouldn't be able. Installments would work for me. On the other hand you probably don't want to get into this sort of habbit either. Hope things work out. And next time it comes to getting money from her ask for cash. Do you have anything in your bylaws that deal with NSF? We do not, but ours are not finished yet. I think I may have to put something in there about that after I talk to our treasurer.
