words like, "therefore in my opinion..." will go a long way towards protecting yourself against charges of slander or libel.

US law dictates that for something to be considered libel (not slander - slander is spoken) it must be proven that the one making the libelous charges (or on a blog or uBB its called cyerlibel) and did so with malicious intent and with full knowledge that the statements were false.

Personal opinion is protected as a First Amendment right. (i.e. Being careful to state the facts of a personal experience in non-malicious language)

sslmom - I'm curious if you have special insight into this situation that you might be willing to share. Perhaps we could help momfirst and her team resolve what is clearly a tempestuous issue.

As for slander, I have to say from a non-lawyer point of view that I don't see any such thing. We use screen names and leave any and all personal info out of these posts. The goal here is to have a safe place to discuss issues, offer our perspective, advise based on personal experience and most of all work together for the benefit of all.

The post was started by a real person with a real concern. Based on a one dimensional view, we do the best we can to help. We never get the full story, all sides being equally represented, so we work with what we have.

If you have a different perspective and can offer advice, constructive criticism or suggestions to help momfirst work towards a positive solution I'm sure it would be greatly appreciated.

I agree with ademom74--if you go to the newspaper you should be very careful to not be slanderous. In fact, you should be very careful not to be slanderous on this message board, because a court of law could order PTO Today to turn over names of those posting slander. Be very careful what you write and say.

lucella they may not be able to force them to open their records but threatening to not let them use school facilities for their program could kill the group...you could call it blackmail...It could work. Would you want to get kiced out of your school facilities, that includes the backpack express!

Just a little note- if this group is 501c3, the Superintendent & BOE have no autority over the proceedures of the group. They can ban the group/offending people from the school, but they cannot force any type of disclosure from them anymore than you or I could. If they are 501c3 & they other members of the group are not supporting this disclosure, the IRS is who to contact.
