The purpose of the petition or should we now say survey is to see if we would get enough followers. As it stands, many of the association members says, lets go for it. That being said, we will follow the californai bylaws and try to get 2/3 of the votes. It seems to me that most parents have no clue of the difference. TThey thought all the money stayed with the school.
Read ARTICLE XI - Charter Procedure of your PTA bylaws. In my state, under Section 5 it reads that if your unit is withdrawing its charter you are obligated: "a. To yield up and surrender all of its books and records and all of its assets and property to the CA State PTA or to another PTA or PTSA organized under the authority of the CA State PTA."
I doubt that you can use a petition to disband. Are you trying to disband as a PTA and vote to become a PTO? You should review your bylaws and follow them closely. Also, you do not have to spend your parent groups money down to zero as long as you donate it to another non-profit organization. If you get your non-profit status up as a PTO, prior to totally ending your PTA, then just donate the money to your newly established PTO. So many groups out there think that they have to spend down every penny or lose it. It's just not the case. Check with a local accountant and/or an attorney for a little free advice over the phone and make sure that you do this the right way. Good luck.
I think -- if you were going to use the petition as a vote -- it would need to be/should be in your bylaws. If absentia votes aren't allowed for other items you act upon, then they shouldn't be allowed here.
That said, I certianly feel like a petition is more than fine to bring up in the discussion part of this meeting.
Assuming there's a motion... and then discussion, then it would be good input (and powerful evidence of support) to share a widely signed petition in support of the change. I'd say the same if the item up for discussion was supporting a new sidewalk monitor program or funding a new computer lab.
O.K. It's set. The executive board will meet and decide PTO or PTA. We already called the members of the association and received a positive feedback. My question is this, many are unable to make it to the association meeting but would like to sign a petion in banning the PTA and adding the PTO.
Has this ever been done?
Also, We are under $1,000 and by the end of the the school year we will be at zero.
We will vote as an executive board what to do with the assets.
I need some advice on whether this has ever been done.
