We do this in KY too. I am glad. If there was a minor incident, it is up to the prinipal to make the call whether the volunteer should be allowed around kids.
I finally found where they did pass this law in Texas. Can't find much about Oklahoma? If anyone is interested where to find out about this new law in Texas let me know! The non-profit organization officers may be held liable.
In a lot of places this is a policy at the city or district level, rather than a state law. All the same, it's becoming a more and more common requirement.
I think on most of the checks, the organization (i.e., the school) basically is told if someone "passes" or not. They aren't given any details. Note - there may be an exception if the person has a criminal history of sexual assault.
Our school does these on volunteers. Our PTO faces something similar when we apply for our annual temporary bingo license for Spring Fling. We have to provide information for checks on all our Board Members and bingo workers. Last year, one was flagged. They called me and said if XYZ person was a bingo volunteer we couldn't get a license. (no details)
Luckily for us, whatever was in his past, this person previously discussed it with the school and they don't consider it a concern. He's well known at the school and very active. We just made sure he was assigned elsewhere for that night. But no one knew any details, and only I and one other (besides the princpal) even knew about the restriction.
You'd have to check with whatever body is enforcing this to see how it works in your area. My first guess would be the school district.
Not sure if it's law here in Colorado but our school has been doing background checks for a few years now. Just as long as they don't want to look at my credit report, I'm okay [img]smile.gif[/img] [img]tongue.gif[/img] .
Has any one heard of a new law that has past in some states that all non-profit organizations, that deal with children under the age of 17, will need to get criminal background checks for all volunteers that work at the school. I've heard it has past in Texas and is pending in Oklahoma.
