I would cover my back if I were you. Write him a polite letter on PTO stationary stating again that you are not a licsensed day care provider. include the phrase, "As we discussed the other day...." The keep a copy in the PTO records. This way if the parent is ever audited, you have a papertrail that should get you off the hook quickly.

Yeah, I don't think you guys are doing anything wrong. You've been honest.

What this person claims on his taxes puts him in jeopardy, not you -- especially where you've been saying the right things.

I don't think you have anything to worry about from this particular set of circumstances.

After School Program, a tax credit? was created by <Boiling Blood>
Hello

We have recently had a member ask us for our EIN #. He wishes to use it for a tax child care credit on his taxes for our after school program we fund. I explained that we are not a child care provider and can not be used for this. He is still insisting we give it to him. I tried to explain our program is sismilar to sending your child to piano lessons or dance class. Now he has informed us that he has obtained the ID # possibly through our own accountant. He keeps comparing us to programs that are child care providers.
Our PTO charges a small fee for this program and totally funds the remainder. We have worked hard to get quality programs in the school and I worry we will have to stop this if somebody abuses it in this way. By using this won't the IRS wonder why we haven't filed forms that a licensed day care needs to file?
I always thought our EIN was like our ss# and I wouldn't give my SS# out freely. Only a few of our board members have it as they don't all need to use it.
If anyone can help us it would be great. I hate to see us stop doing the great work we are doing for the children to enhance their learning education.
My blood is boiling knowing that one person could be the demise of a wonderful program like this to save a buck!
