Write in candidate dispute

So Phil, when I was having a baby on election day and was elected Secretary I should not have been elected becasue I was in the hospital? I had accepted the nomination and was very clearly unsure of being able to attend the following meeting....may need to look that one up with Roberts Rules.

Write-ins are allowed in ballots. Bugs Bunny has been recevied several votes in our PTO when parents didn't agree with the nominee choices (God forbid THEY stepped up!) AND folks can be nominated as long as they give a yes or no within the allocated time allowed in your by-laws.

The Presdient last year was nominated at a meeting and called a day later for him to accept. He was flattered a parent took him seriouly about being involved and he was out of town the night of our meeting.

LB-If YOU are not comfortable with a write in space that needs to be openly discussed with your board. I am running unapposed myself Monday and am very nervous because we require a write in space on our ballots. Did I mention the Secretary has been very vocal with teachers her dislike for me? Yeah....I may be running against her write in or, gasp, Bugs Bunny!!

Write in candidates are acceptable but they must be in attendence at the meeting to accept if they win. If they are not in attendance they are unable to accept and the votes for that candidate do not count.

If the by-laws state there are 5 board positions, then there are only 5 board positions and the person who gets the most votes for each position gets it. Period. I really don't understand this 1-vote-we-find-a-position-for-you thing. That is a quick way to anarchy.

normally one cannot just nominate anyone withouut their consent. usaully, the nominee has to agree with signatory, that they accept the nomination. seems odd to not check the intent of the person being put up for vote. if there is no consent, it will never work out anywya even if they win becuase the motiveation wont be there.

YIKES! Something is rotten in Denmark! & Ditto to what all the others have said thus far. Why would anyone run for office when they can have someone write them in and only need one vote to get a board seat? That one vote to get a board seat is the big red flag in all of this. Why does the write in only need one vote when a running nominee has to win by a majority of votes?

There is nothing wrong per say with a write in spot but they should have to win by a majority of votes. The other flaw here is that just because someone writes someones name in and one person votes for them does not guarantee that the person even wants the board seat to begin with. We had at least 4 people nominated this year for board seats who all declined the nomination.

But regardless of this craziness. You need to abide by your bylaws. They can vote to ammend them but in the meantime you need to go with what they say.

Do your bylaws have an article in them describing which (if any) parliamentary authority they adhere to?
If it's Roberts, then you are obliged to not only take nominations from the floor but write-ins as well unless your bylaws specifically mention them as not being allowed.
Your president- or anyone- should not go so far as to allow a one vote winner to have a seat on your board unless that ONE vote was the ONLY vote, hence a winning candidate.

i would check first to see if the bylaws state if they can do this or not, but i agree with crew chief. Something definately sounds fishy. they sould not be aloud to do this without changing the bylaws first. if that time has past(to change the bylaws), they should have to wait until next year. depending on your bylaws, i would think that would not be acceptable. if nominations are closed, they're closed.
