If it hadn't been for the embezzlement, our group would have a separate EIN. I was just getting around to filing all the paperwork for incorporation when this occurred. So, yes, the EIN's are the same. I didn't even think about that, although I did tell the principal that the money in the account does belong, literally, to the school. I just didn't put two and two together. With the thought now complete, I think the certified letter is probably best.

P.S. I'm the kind who likes to see karma work too... thing is, I wasn't completely blameless here. I'm not sure everyone here realizes that. And some of that old fashioned karma is already happening. The group is being disbanded and that is really ticking them off. I have received a threatening phone call from the secretary and the treasurer is telling anyone who will listen that according to the bible, people simply can no longer be friends with me... As for me, I simply have better things to do with my time than to stay angry or to hate either one of these gals... Although I must say that I'd still like to flex those four muscles to both gals for saying that I volunteer too much...

I'm not sure about this one. This is a case where I would LIKE having the EIN being the same as the school's.

Is the EIN the same as the school's? If it is, I should think it is now the responsibility of the prinicpal, or whomever he deems worthy of the job to get all the important paperwork back. Sending a certified letter to the treasurer and secretary is probably the best way to do that--paper trail and all. As far as the checkbook goes, I'd call the bank. Your current president or principal would have the authority to change the signatures--especially if the group has been disbanded, and you'd probably have to sign some sort of release giving the school the account.

If the EINs are separate, I don't see how the principal could have had you disband or take over the account--BUT I would then think the remaining officers would have to meet--WITH A WITNESS, i.e. the principal, and decide what to do. If it is a separate EIN it could be a lot messier. Still, I'd go to the bank and ask them what to do. You'd probably have to sign some sort of release turning the account over to the school, in which case the principal and whomever else he wanted would be the official signers.

I'm with Serendipity on this! The only problem I have with karma though is that I want to be around when ill happenings befall my tormenters, so I can enjoy it! ;)

Which officers names are currently on the account?

Can the checkbook be turned over to the principal?
The Checkbook and financial records can be kept in his office. Why not put his name on the account along with either your name or your friends name who became the President.

Do they have a time frame of when they will institute a new PTO? Do you have any idea when your embezzlement money will be put into that account?

I read the thread on what happened in that meeting and all I want to say is what comes around goes around. I am a true believer in karma and am so glad that this horrible situation all worked out for you. You keep your head high and let those other women crawl right back under the rocks they slithered out from under. I hope their happy with the situation they created for your school!

OK. Our group is being disbanded. Believe me, it isn't as bad as it sounds. Volunteers will still do their thing, money will still be raised (for the general fund), there just won't be an organized group. Here is the dilema:

The treasurer is REALLY ticked off. The secretary is REALLY ticked off. I was the pres but resigned before it was decided to disband. The vice pres is filling the pres position as is dictated by the bylaws. The principal and current pres agree that the group should be disbanded for now. Who's job is it to get the bank book and finacial records back? Once it is done, what is done with the bank book as far as signatures? The money in the account will be used to pay off a copy machine and service contract, purchase math and reading books for several grades, reconcile the fundraising company, etc. Anything left over will go to the school's general fund. The inventory from the group (copy paper, fundraising incentive give-aways, previously purchased red ribbons, candy canes, etc.) are currently being inventoried and given to whomever will be handling it - like our resource officer, who is a cop, will get the red ribbons). Everything is being taken care of but we don't know the proper protocall for retrieving the checkbook and how to handle check writing. We can't quite close the account because we are expecting restitution from an embezzlement that happened over the last two years. The embezzlement money will be put aside by the school/district for our new playground.

OMG!!! It's just so confusing!!!
