I don't know about legal issues but personally I feel like it is hard to choose which parents companies you use and which you don't. Especially if they are profiting directly. We have several similar businesses, I believe in using them when we can, but when you get two that are the same, how can you choose which one to use??

A Board Officer of our PTO is actively involved in our next fundraiser. We will be selling a product from a company that the Officer is a sales consultant of. This Board member will receive a commission from the sale of products in our fundraiser. Other members of our PTO have expressed concern about a Conflict of Interest with this situation.

Is it a Conflict of Interest for a Board member to profit from a PTO fundraiser? What legal issues could result from this?
