Then, unless the by-laws change, you are ready to cut off the inappropriate motion immediately. The chair declares the motion out-of-order, and barring a successful appeal of the ruling the issue is closed. In fact, if anybody objects to the introduction of any motion, the chair is required to issue a ruling.

In our PTA's all bylaws have expiration dates on them.. A unit can amend their bylaws but only with an announced bylaw amendment vote. Meaning a notice must be posted to all members advising them that their is a proposal to amend Article X section 1 of our current bylaws presently reading as TO NOW BE AMENDED AS FOLLOWS then state word for word the propsed change. Now even if the unit approves the amendmnet it must still be approved by your state and national levels.

We recently had a motion deemed illegal because it went against our rules and bylaws. The group that was shot down said that it will bring the request back next year. My question, if you rule that a motion is illegal and it is not appealed can the motion be brought back next year? Does anyone know of a written answer for this or where the correct answer may be? This group will want to see that reponse in writing by some legal expert. Any help would be greatly appreciated.
