PTO 501c3 asked to pay for Lawyer for community

12 years 4 months ago #160244 by Rose H
Hi RidgeCrest PTO

It sounds like your group needs to first have the discussion to figure out if folks are really behind supporting this. If your group does want to pursue it, you might want to consider a way to control what you will spend rather than just getting behind a legal pursuit. For example, you could say that your group will cover the costs for an initial legal consultation. This way, you are contributing and you are managing the cost. Otherwise, you run the risk of very quickly using up whatever funds the group has, as legal costs can quickly add up.

Best of luck in this,

Our PTO is a 501 C3 non profit. Because of district cutbacks our school is being closed at the end of this year. We're sad about that, however, several community members have asked if the PTO would be willing to help pay for a lawyer to contest this with an injection based on the land deed and the intent of the family that donated the land. I've check our bylaws and, although I'm hesitant to put this up to a vote, we could technically help pay for this, if it was approved by our board. Our bylaws say that PTO can pay for anything that contributes to the school or it's students learning. It does say that we can't donate to political causes or certain party's or political figures, however, that doesn't apply here. I want to do it the right way and don't want to raise eyebrows and get audited. I think the PTO can put some money towards it, but not all, since not all parents agree with it and donating the whole amount would in essence say that all parents agree with it.

Any help, advice or ideas would be greatly appreciated.

Thanks.
PTO Prez.
