Hi reality1, I'm not sure what you mean by giving it "back", back to whom? The parents?

When we dissolved our PTA unit we made sure there wasn't much money left, but then we did have to make sure any remaining funds went to another recognized 501c3 organization (we gave ours to the education foundation in town). That was an IRS rule (because we were a 501c3) more than a PTA rule.

Is it part of the PTA rules that you have to give back any money left over in the general fund before dissolving the PTA?

We are looking into the benefits of PTA vs PTO. We are currently a PTA and the benefit of insurance is what the past officers seem to talk about the most. Can anyone fill me in on the need for insurance and what it covers?

You don't "have to" dissolve the PTA first. In fact, it's technically possible to have both a PTO and a PTA active in a single school (we don't recommend that).

We definitely hear of many groups running quite informally and "through" the school. It's possible, but -- like not having bylaws -- not having the legal ducks in a row will be a problem when/if tricky spots ever arise. It *is* possible that those tricky spots will not arise, of course. But....

That said, it's a myth that getting the ducks in a row is expensive and very difficult. In fact, it will be getting even easier in the next few weeks when our National PTO Network (NPN) debuts. One of the many features for parent groups of NPN membership will be a comprehensive "Expert Guide" on start-up issues like incorporating, bylaws, nonprofit status and insurance. (Other comprehensive Expert Guides will follow.) NPN membership will also include access to a group-discount insurance plan for parent group insurance.

I think it will be a nice help for you. Watch the site for details later in July.

Thanks for the replys, I recently asked another PTO Pres. in our area, and
she says that they do all their PTO business thru the school, they use the
tax id# of the school's. They do have bylaws, which I agree with all of you,
that is very important, it seems there is always at least one in every crowd
that will make trouble if they think they can, but, anyways, they are not
incorporated, filed no paperwork with anyone, and they usually raise between
$2000 up to maybe $10,000 in a year. they recently had a huge fund raising
effort for playground equip. and raised like $17,000, but that is not some
thing they do regularly. she says they have never had a problem with doing
things that way. we have other groups in our school that fund raise on a
regular basis, such as 8th grade, Beta Club, and they just use the school's
tax id#, is PTO that much different? to respond to the last post before this,
we did find out that we had to spend all of our funds we raised as a PTA and
alert PTA of our decision to disband. The former Pres. and I have been doing
that with our summer program and preparing early for our annual fall festival,
we also have started putting together our own bylaws. they are almost done.
we are a very small town(village) and we have no $$$$$ and i was told that
it was expensive to get incorporated and all that. Of course, we want to be
legal, that is our main concern, is not to do something against some law we
dont even know about!! anyone else have anything else for us?? thank you
